If the owner of the Vermont Yankee nuclear power plant in Vernon wants relief from a state tax, it will have to go to state court to get it. The Vermont federal district court issued a 16-page decision just after 4 Thursday afternoon dismissing a challenge brought by Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. to Vermont’s Electrical Energy Generating Tax (“EET”). The EET imposes a tax of $0.0025 per kWh of electricity generated by large capacity power plants, of which Vermont Yankee is the only one in the state.
